News Summary

The Department of Justice has officially labeled Rhode Island as a ‘sanctuary jurisdiction’ under a new federal list. This designation is part of an executive order from President Trump, highlighting the state’s alleged violations of federal immigration law. Rhode Island now joins Boston and several other states in facing potential legal actions due to their sanctuary policies, which the DOJ claims hinder law enforcement efforts. Attorney General Pamela Bondi has indicated that the DOJ will pursue litigation against jurisdictions with sanctuary designations, emphasizing the administration’s focus on immigration enforcement.

Providence, Rhode Island – The Department of Justice (DOJ) has officially designated Rhode Island as a “sanctuary jurisdiction” under a new federal list, part of an executive order signed by President Donald Trump on April 28. This designation serves as a formal identification of states, cities, and counties that the federal government claims “violate, obstruct, and defy the enforcement of Federal immigration law.”

Rhode Island was included in the list, which was released on Tuesday, alongside the City of Boston, Massachusetts, and 13 other states. Other jurisdictions that share this label include California, New York, Illinois, and nine additional states, which federal officials assert impede immigration law enforcement efforts.

According to Attorney General Pamela Bondi, sanctuary policies are regarded as a hindrance to law enforcement and are argued to endanger American citizens by creating environments where individuals who may pose threats are allowed to remain without oversight. As part of its ongoing strategy, the DOJ plans to initiate litigation against sanctuary jurisdictions while collaborating with the Department of Homeland Security (DHS) to eliminate such policies.

This designation follows a meticulous examination by the DOJ of documented laws, ordinances, and executive directives from the listed jurisdictions. Rhode Island may now face potential legal challenges similar to those encountered by other sanctuary jurisdictions in recent months, reinforcing the administration’s focus on immigration as a key priority.

Criteria for Sanctuary Jurisdictions

The DOJ has outlined nine specific criteria that are used to classify a jurisdiction as a sanctuary. These include:

  • Public declarations of sanctuary status.
  • Laws that restrict cooperation with U.S. Immigration and Customs Enforcement (ICE).
  • Limitations on sharing information regarding detainees’ immigration status.
  • Policies that deny ICE detainer requests without a signed warrant from a judge.
  • Restrictions on ICE agents’ access to interview detainees.
  • Establishment of offices aimed at advising immigrant communities on avoiding federal law enforcement actions.
  • Provision of benefits to individuals living in the country illegally that bypass federal prohibitions.

The list is not meant to be comprehensive and will undergo updates as more information becomes available on additional jurisdictions. Each named jurisdiction will have the opportunity to contest its designation on the list.

The Broader Context

The Trump administration has emphasized the importance of enforcing immigration laws, which is apparent in the executive order titled “Protecting American Communities from Criminal Aliens.” Federal officials have expressed their willingness to cooperate with any jurisdiction wishing to be removed from the list, stipulating that it must first address and eliminate its sanctuary policies.

Previously, the DOJ has initiated several lawsuits against other sanctuary jurisdictions, notably filing a case against New York City on July 24. The states of Connecticut and Vermont were also acknowledged on this latest list, showcasing a regional pattern in the Northeast.

As the DOJ continues its collaboration with the DHS, the federal enforcement of immigration laws remains at the forefront of the ongoing political and legal debates surrounding immigration policy in the United States. The designation of Rhode Island as a sanctuary jurisdiction may prompt renewed discussions on the impact of such policies on community safety and federal law enforcement efforts.
